Indias Labour Law Overhaul: Will States Deliver on Promised Job Growth and Social Security?

New Delhi – India’s corporate sector is bracing for a seismic shift following the central government’s implementation of the long-awaited four labor codes. Effective immediately, the new regulations are poised to reshape employment norms, social security frameworks, and HR practices across the country.

The move has been hailed by industry bodies like Nasscom as a pivotal moment in India’s labor reform journey, promising to accelerate formal job creation and expand the social security net. However, experts caution that the true impact hinges on the effectiveness of state-level implementation.

International Labour Organisation Director-General Gilbert F. Houngbo emphasized the importance of social dialogue between government, employers, and workers to ensure the reforms benefit both workers and businesses. Key changes impacting employers include mandatory annual health check-ups, gratuity eligibility for fixed-term employees, social security benefits for gig and platform workers, and stricter enforcement of timely wage disbursement.

Akhil Chandna, Partner at Grant Thornton Bharat, advised employers to promptly align internal policies and operational processes with the new codes, emphasizing the need to review compensation and benefits structures in light of the revised definition of ‘wages.’ The immediate notification caught many off guard, requiring a rapid response to ensure compliance.

Nasscom anticipates the reforms will curb the misuse of employment norms prevalent in the IT sector, such as the exploitation of fixed-term roles and the misclassification of employees as ‘consultants’ to avoid providing benefits. Harpreet Singh Saluja, president of NITES, stressed the importance of carefully framed and enforced rules, along with the preservation of trade union rights, to prevent companies from circumventing their obligations.

Manish Sabharwal, Vice Chairman of Teamlease, lauded the codes as a long-overdue benefit for India’s young population, factories, MSMEs, and backward states, predicting they will accelerate the creation of formal, non-farm jobs. Uber echoed this sentiment, expressing eagerness to collaborate with the government for the efficient implementation of the reforms.

Suchita Dutta, Executive Director of the Indian Staffing Federation (ISF), believes the new labor codes will simplify compliance, reduce regulatory burdens, and foster a more flexible hiring environment, driving formal employment growth. Puneet Gupta, Partner at EY India, highlighted the clarity, digitization, and consistency the codes bring, contrasting them with previous laws that suffered from multiple interpretations.

Gupta emphasized the significant impact on workers, with formal employees gaining stronger protections and gig and platform workers being included in social security schemes for the first time. The reforms are expected to reshape compensation structures, HR policies, and employment models, fostering a more inclusive and future-ready labor ecosystem.

The implementation of these labor codes marks a critical juncture for India’s workforce and business landscape. The coming months will be crucial in determining whether the reforms can deliver on their promise of greater formalization, social security, and improved working conditions for millions of Indian workers.
